1. Who we are
This website is run by the Art & Creativity Consortium (“ACC”, “we”, “us”), a non-profit association (Verein) under Articles 60 ff. of the Swiss Civil Code, with its seat in Lugano, Ticino, Switzerland. You can reach us through the contact form.
2. Using this website
You may use this website for lawful purposes and in line with these terms. You agree not to misuse it, for example by trying to disrupt it or gain unauthorised access, by sending spam or automated submissions through our forms, or by submitting content that is unlawful, abusive or infringes the rights of others.
3. Messages and applications
When you write to us through the contact form or apply through the volunteer form, you confirm that the information you give is accurate and that you are entitled to send it. If you upload a file, such as a CV, a portfolio or samples of your work, you confirm that you hold the rights to it or have permission to share it with us. We use what you send only to answer you or to assess your application, as described in our Privacy policy. Sending a message or an application does not create any obligation on our side to reply, to accept the application or to publish your work.
4. Volunteering
Volunteer roles at ACC are unpaid and are not employment. Details of each role, including the requirements, are published on the Volunteer page. A volunteer role begins only when we confirm it to you, and either side may end it at any time. Where we credit a volunteer on a published title or provide a reference letter, we do so as described for the role on our website. Volunteers keep the confidentiality of unpublished texts and artworks they receive from us, and do not use them for any other purpose.
5. Intellectual property
The content of this website, including texts, layout, logos and the names of ACC and its publications, belongs to ACC or its licensors and is protected by copyright and other rights. You may view and share links to the website, but you may not copy, adapt or reuse its content for commercial purposes without our written permission. Works published by our imprints and magazines remain the property of their authors and are used under the agreements made with them.
6. Donations
Donations to ACC are voluntary. Unless the law requires otherwise, donations already made are not refundable. Information on how to donate is on the Donate page.
7. Links to other websites
This website links to other websites, for example those of our publications. We do not control them and are not responsible for their content or their handling of personal data.
8. Availability and liability
We try to keep the website accurate and available, but we provide it “as is” and do not guarantee that it is free of errors or interruptions. To the extent the law allows, ACC is not liable for indirect or consequential damages arising from the use of this website. Nothing in these terms limits liability that cannot be excluded under Swiss law, such as liability for intent or gross negligence.
9. Personal data
We handle personal data as described in our Privacy policy.
10. Changes
We may update these terms when our website or our activities change. The version published here applies from the date shown at the top.
11. Governing law and jurisdiction
These terms are governed by Swiss law. The courts at the seat of ACC in Lugano have jurisdiction, unless mandatory law provides otherwise.
