General Terms and Conditions of Membership

1. Definitions

1.1. “ACC” refers to the Art & Creativity Consortium, an independent European cultural network for creators, organisations, and cultural practitioners.
1.2. “Member” means an individual or legal entity whose membership application has been accepted in accordance with these Terms.
1.3. “Membership” means access rights, benefits, and services granted by ACC to its Members.

2. Purpose

These Terms govern the rights and obligations of Members and ACC in respect of membership services, including eligibility, application, renewal, fees, benefits, and termination.

3. Eligibility

3.1. Membership is open to individuals and organisations aligned with ACC’s cultural objectives and mission, including but not limited to writers, artists, editors, small publishers, cultural organisations, and entities seeking cross-border cultural cooperation.
3.2. Membership is discretionary; acceptance does not guarantee representation, publication, or any other outcome.

4. Application and Acceptance

4.1. Prospective Members must complete the membership application form accurately and fully.
4.2. ACC may request additional information if necessary to process an application.
4.3. Membership becomes effective only upon written confirmation by ACC and receipt of the applicable fee.

5. Membership Fees

5.1. Membership fees are as listed on the ACC website and may be subject to change.
5.2. Fees are non-refundable except as required by law.
5.3. Payment obligations commence on acceptance of membership.

6. Rights and Benefits

6.1. Members are entitled to access benefits associated with their membership tier, as published on ACC’s website.
6.2. Benefits are subject to change; ACC will provide notice of significant changes.

7. Member Obligations

7.1. Members must comply with these Terms and ACC’s policies as published and updated from time to time.
7.2. Members shall not act in a manner that harms ACC’s reputation or the interests of other Members.

8. Personal Data and Privacy

8.1. ACC collects and processes personal data in accordance with EU data protection law, including the General Data Protection Regulation (GDPR).
8.2. Members have rights to access, rectify, erase, and restrict processing of their personal data where applicable under GDPR.
8.3. ACC will only process personal data necessary for membership administration, communication, and fulfilment of benefits.

9. Communication and Notices

9.1. ACC will communicate with Members primarily via the email address provided in the application.
9.2. Members must keep their contact details up to date.

10. Fees Renewal and Termination

10.1. Membership is annual and must be renewed by payment of the applicable fee.
10.2. ACC may suspend or terminate membership if fees are not received or if a Member materially breaches these Terms.
10.3. Members may resign at any time by written notice; fees already paid are not refundable.

11. Intellectual Property

11.1. Members acknowledge that ACC retains all rights to its intellectual property, including branding, logos, and published material.
11.2. Member use of ACC’s intellectual property must comply with ACC’s guidelines and may be revoked at any time.

12. Liability

12.1. ACC shall not be liable for indirect, incidental, or consequential losses arising from membership, except as prohibited by applicable law.
12.2. ACC’s total liability under these Terms shall not exceed the membership fee paid in the relevant year.

13. Governing Law and Jurisdiction

13.1. These Terms are governed by the laws of Belgium or another EU Member State where ACC may be incorporated.
13.2. Disputes shall be resolved by competent courts in the Member State of ACC’s legal seat.

14. Amendments

ACC reserves the right to update these Terms. Members will be notified of material changes with an opportunity to accept revised terms or discontinue membership.
